MIO Alpha BLE

Heart rate, as athletes know, indicates fitness and exercise intensity better than most other metrics. Until very recently, the only reliable way to measure heart rate was to wear a chest strap, as I did while testing the Digifit iCardio Multi-Sport Heart Rate Monitor. I can say from personal experience that they're not only uncomfortable, but also require another device to read their output, and try doing that while maintaining speed and watching where you're going. A new wristwatch, the MIO Alpha BLE ($199 direct) reads heart rate through an optical sensor on its back and displays it in real time. Simple as that.

For running, cycling, and plenty of other endurance sports, the Alpha represents a huge upgrade in comfort and ease-of-use in heart rate monitors. It includes a number of useful features and settings, too, such as stopwatch functionality during which you can record your heart rate and keep track of your time spent in the zone (between the low and "up" heart rate you set for yourself). Considering the $200 price, though, the MIO Alpha BLE is somewhat expensive. Because I follow the rapidly growing field of activity trackers and other personal fitness gadgets, I wanted the Alpha to do a little more, such as measure distance traveled or steps taken, which it does not. You can get some of these stats by pairing the MIO with a compatible app, such as MapMyRun or RunKeeper, but I'd ideally like to see a pedometer-like reading right on the device itself.

Design
Much more comfortable than a chest strap, the MIO Alpha looks like a chunky sports watch, with a pliant, durable silicone band. The watch face, available in two accent colors, "shadow" (black) and "arctic" (white), displays data in large format using a negative dot matrix LCD, which makes it easy to read even in strong sunlight. On both the left and right of the watch is a single button that's flush against the watch face, for navigating the features and changing the settings.

It also comes with a USB charging station for the rechargable lithium polymer battery, which attaches magnetically to the back of the watch.

I find the device rather attractive, and especially like the row of three holes in the band, for securing with a three-pronged clasp, that travel its entire length. The MIO Alpha should be worn a little higher on the arm and more snugly than a typical watch, as it needs to be in close contact with your skin to accurately read your heart rate. Of course, when you're not taking your heart rate, you can readjust it to wherever it's most comfortable.

How it Works
The MIO Alpha BLE works by using an optical sensor, located on the back of the watch, to read the volume of blood under your skin, and therefore take your pulse. The heart rate function does not run constantly. You have to turn it on and off. Press and hold the right side button, and it will read your current heart rate, displaying it on the watch face in real time. When you?re not taking your heart rate, the MIO Alpha displays only the time.

Accuracy
In testing the MIO Alpha BLE, I took several readings of my resting heart rate just to get a sense of how the device worked and found it to always be within two beats per minute of my own reading (using the rudimentary two-fingers-to-the-neck method).

Then, I wore the watch to the gym and took a few more readings that I compared with the readings from the hand-grip sensors on some cardio equipment, which are sometimes accurate and sometimes ghastly off. I jumped on an elliptical trainer, took a few readings using the hand sensors to make sure they were at least within the range of my expectations (they were), and worked up a sweat. I turned on the Alpha MIO and started comparing. Every reading was once again within two beats per minute. Impressive.

Additional Features
The button to the left of the watch face activates additional features that make the MIO Alpha BLE a true athletic gadget. You can adjust your minimum and maximum desired heart rate (it defaults to 110 to 130 beats per minute), and while you're working out, the Alpha will beep if you're not in the desired zone. It also flashes a colored light to indicate whether you're over (red), under (blue), or within (green) the zone you set.

You can also turn on a stopwatch feature that lets you time an activity while reading your heart rate in the background, which is where the colored lights and audio cues really help, as you can hear them and see them from the corner of your eye without slowing down to focus on the precise reading.

To integrate your heart rate stats into other data from health and fitness apps, you'll need a mobile device with Bluetooth 4.0, and one of the following compatible apps: Adidas MiCoach, Endomo, MapMyRide, MapMyRun, RunKeeper, Strava, or Wahoo Fitness.

While the watch is waterproof and you can even swim while wearing it, the instructions warn against pressing the watch's buttons while underwater. You'll need to turn on the heart rate function and set up the timer before hopping into the pool.

Pricey, but Among the Best
I highly recommend the MIO Alpha BLE over a chest strap for any athlete or fitness buff looking to add heart rate to their personal data measurements. For the price, however, I do wish it had at least one or two more features for tracking activity directly, although for the time being, at least you can pair it with an app.

If in its second or third iteration the MIO Alpha can add a few key personal fitness tracking features, such steps taken and total distance traveled, it might be a five-star product. The question is whether it will get there first, as the competition is fierce?which is a good thing for consumers.

APNewsBreak: Harkin won't seek 6th Senate term

CUMMING, Iowa (AP) ? U.S. Sen. Tom Harkin said Saturday he will not seek a sixth term in 2014, a decision that eases some of the burden the national Republican Party faces in retaking the Senate.

Harkin, chairman of an influential Senate committee, announced his decision during an interview with The Associated Press, saying the move could surprise some.

The 73-year-old cited his age ? he would be 81 at the end of a sixth term ? as a factor in the decision, saying it was time to pass the torch he has held for nearly 30 years, freeing a new generation of Iowa Democrats to seek higher office.

"I just think it's time for me to step aside," Harkin told the AP.

Harkin, first elected in 1984, ranks seventh in seniority and fourth among majority Democrats. He is chairman of the Health, Education, Labor and Pensions Committee, and chairman of the largest appropriations subcommittee.

Harkin has long aligned with the Senate's more liberal members, and his signature legislative accomplishment is the 1990 Americans with Disabilities Act. He also served as a key salesman of President Barack Obama's health care overhaul to the wary left.

"I'm not saying that giving this up and walking away is easy. It's very tough," Harkin said at his rural Iowa home south of Des Moines. "But I'm not quitting today. I'm not passing the torch sitting down."

Harkin's news defied outward signals. Besides being beloved in his party, Harkin has $2.7 million in his campaign war chest, second most among members nearing the end of their terms, and was planning a fundraiser in Washington, D.C., next month featuring pop star Lady Gaga.

Obama released a statement saying Harkin will be missed and thanking the senator for his service. "During his tenure, he has fought passionately to improve quality of life for Americans with disabilities and their families, to reform our education system and ensure that every American has access to affordable health care," Obama said.

Although members of his family have been diagnosed with cancer, Harkin said his health is good ? and reported a recent positive colonoscopy. But he said "you never know," and that he wanted to travel and spend his retirement with his wife, Ruth, "before it's too late."

He also nodded to his political longevity: "The effect of that cascades down and it opens a lot of doors of opportunity" for future candidates.

But by opening a door in Iowa, Harkin has created a potential headache for his party nationally.

Democrats likely would have had the edge in 2014 with the seat, considering Harkin's fundraising prowess and healthy approval. A poll by the Des Moines Register last fall showed a majority of Iowans approved of his job performance.

Democrats hold a 55-45 advantage in the Senate, requiring Republicans to gain six seats to win back the chamber. But Democrats have more seats to defend in 2014 ? 20 compared with only 13 for Republicans. Historically, the president's party loses seats in the midterm elections after his re-election.

In GOP-leaning West Virginia, five-term Democratic Sen. Jay Rockefeller recently announced he would not seek re-election. And on Friday, Georgia Sen. Saxby Chambliss, a Republican, announced that he wouldn't seek a third term.

Democratic incumbents also face tough re-election races in Arkansas, Louisiana, Montana, North Carolina and Alaska ? all carried by Republican Mitt Romney in November's presidential election.

Harkin's move opens a rare open Senate seat Iowa. Harkin, Iowa's junior senator, is outranked by Sen. Charles Grassley, who has held the state's other seat since 1980.

Attention will turn to U.S. Rep. Bruce Braley, a fourth-term Democrat from Waterloo who has long been mentioned as a possible Harkin successor. Braley, who was traveling in Iowa, did not immediately return requests by the AP for comments beyond an emailed statement calling Harkin a "mentor" and "progressive force" who leaves "a legacy few will ever match."

Harkin held open the possibility of endorsing a Democrat before the primary if the candidate "is a pragmatic progressive."

Although no Republicans have stepped forward, Harkin's news gives the GOP's private huddles new life.

"There are lots of conversations, but it's very early still," said Nick Ryan, an Iowa Republican campaign fundraiser.

U.S. Rep. Tom Latham of Clive is a seasoned Republican congressman, a veteran House Appropriations Committee member and a robust fundraiser who has won 10 consecutive terms. Aides to Latham declined to comment beyond a statement saying the congressman "respects Sen. Harkin's decision (and) looks forward to continuing to work with him."

Since November, Harkin has stepped up his role as one of the Senate's leading liberal populists.

He was a vocal opponent late last year of Obama's concession to lift the income threshold for higher taxes to avoid the so-called fiscal cliff. Harkin instead supported raising taxes on all earners making more than $250,000 a year.

He also endorsed Obama's call for banning assault rifles and larger ammunition magazines after the Connecticut school shooting.

Despite Harkin's strong political position, he has faced questions about his and his wife's role in developing a namesake policy institute at Iowa State University, Harkin's alma mater. The Harkins and their supporters have been pushing for the institute to house papers highlighting his signature achievements, including the ADA and shaping farm policy as the former chairman of the Agriculture Committee.

Harkin has avoided questions about fundraising for the institute after disclosure reports showed some of its largest donors are firms that have benefited from his policies.

Harkin dismissed that those questions had any bearing on his decision.

Dozens reported killed in Venezuela prison riot

CARACAS, Venezuela (AP) ? A bloody riot erupted in a Venezuelan prison when National Guard troops clashed with armed inmates, and Venezuelan media reported that dozens were killed.

Vice President Nicolas Maduro called the violence tragic early Saturday on television and said the authorities had launched an investigation. He and other officials did not give a death toll from the riot Friday at Uribana prison in the central Venezuelan city of Barquisimeto.

The newspaper Ultimas Noticias reported on its website that 54 people were killed. The television channel Globovision reported at least 50 killed and about 90 injured. Both cited Ruy Medina, the director of Central Hospital in the city.

Humberto Prado, an activist who leads the watchdog group Venezuelan Prisons Observatory, said in a statement that inmates' relatives and media accounts put the toll at 54 killed and 88 injured.

Relatives wept outside the prison during the violence, and cried outside the morgue Saturday as they waited to identify bodies.

Penitentiary Service Minister Iris Varela said Friday that the riot broke out when groups of inmates attacked National Guard troops who were attempting to carry out an inspection.

Varela said the violence had affected a number of prisoners and officials, but said the authorities would hold off until control had been re-established at the prison to confirm the toll. She said the government decided to send troops to search the prison after receiving reports of clashes between groups of inmates during the past two days.

The death toll provided by Medina rose late Friday after he had initially reported four killed and dozens injured. Ultimas Noticias reported that the victims included a Protestant pastor and a member of the National Guard, as well as inmates.

Opposition leader Henrique Capriles condemned the government's handling of the country's overcrowded and violent prisons.

"Our country's prisons are an example of the incapacity of this government and its leaders. They never solved the problem," Capriles said on his Twitter account. "How many more deaths do there have to be in the prisons for the government to acknowledge its failure and make changes?"

Prado noted in his group's statement, which was posted on Globovision's website Saturday, that in 2007 the Costa Rica-based Inter-American Court of Human Rights had ordered the Venezuelan government to seize weapons that inmates had in their possession at Uribana prison and to take measures to avoid deaths in the facility.

The observatory called for the government to release a list with the names of the dead and wounded, as well as details about weapons seized in the search. It also said the government should adequately train security forces to "effectively guarantee the right to life and avoid the disproportionate use of force."

The group says Uribana prison was built to hold up to 850 inmates but currently has about 1,400.

It was the latest in a series of bloody riots in the country's prisons. In April and May, a prison uprising in La Planta prison in Caracas blocked authorities from going inside for nearly three weeks. One prisoner was killed and five people were wounded, including two National Guard soldiers and three inmates.

Two months later, another riot broke out at a prison in Merida, and the Venezuelan Prisons Observatory reported 30 killed.

In August, 25 people were killed and 43 wounded when two groups of inmates fought a gunbattle inside Yare I prison south of Caracas.

In recent years, violence has worsened inside Venezuela's severely overcrowded prisons, where inmates often freely obtain weapons and drugs with the help of corrupt guards.

Venezuela currently has 33 prisons built to hold about 12,000 inmates, but officials have said the prisons' population is about 47,000.

Maduro said early Saturday that Prosecutor General Luisa Ortega Diaz and National Assembly President Diosdado Cabello were leading the investigation into the newest riot.

"The prisons have to be governed by law," Maduro said.

Chavez's government has previous pledged improvements to the prison system, but opponents and activists say the government hasn't made progress.

Importance of Trademark Protection, Why Is It needed ? Internet ...

bookcover4_corporatelaw.jpg

Like any trademark, even domain names are subject to the legal protections from any sort of infringement that they go through; thus, domain name registrants can get protection from the intellectual protection right laws that are applicable in almost all advanced countries and member of international trade laws. Moreover, as there are a number of existing and potential buyers of international names that may come across with infringement of their rights, they may get the same addressed at WIPO as it provides arbitration and mediation when some dispute with respect to the same arises.

However, legal cure of infringement comes next and it may not even appear if there is right trademarks protection strategy at place. The domains and sub-domains can get maximum protection using right technology and hiring the companies that are known to provide trademarks protection. Nevertheless, it is quite essential from the point of view of brand protection to get protection for domains and sub-domains which have become trademark of their own type. The major function of the entire trademarks protection is to protect the brand from any sort of abuse or misuse by miscreants or unscrupulous elements.

Nevertheless, registering a domain name as a trademark and registering a domain name are slightly two different things. Thus, a user cannot register the the .com, however, if the use of the fits the laws criteria, the same can be registered without much hassle. There cannot be better thing than consulting an attorney for the purpose of domain name registration as trademark for they know well what are the specific requirements for a to become a trademark and get protection from intellectual property right laws.

The buyers can get a registered if it does not infringe upon any other or it is not confusingly similar to some existing domain name. The lawyers who are familiar with the Internet, and their qualification to become trademarks can provide the much needed legal consultation with respect to the intellectual property laws that are applicable. Thus, the laws prior to registering the concerned as a trademark are lucid clear, that is, a can though be bought, getting the same as trademark is little different and needs additional qualifications.

Trademark protection using technical inputs and envisaging the legal tools that are essential to provide the much needed protection for trademark have become right option for companies that are brand conscious.

There cannot be better thing than consulting an attorney for the purpose of domain name registration as trademark for they know well what are the specific requirements for a domain name to become a trademark and get protection from intellectual property right laws.
