Florida High School Uses Female QB in Preseason Game

South Plantation High School could make Florida history this season thanks to its third string quarterback, a 17-year-old girl named Erin DiMeglio.

The Sun-Sentinel reports DiMeglio, the third-string QB or South Plantation, entered a preseason game for the team with 10 minutes remaining.

DiMeglio completed two passes in her short stint on the field.

"I had a girl try out at wide receiver that couldn't make it through practice and I had a kicker that really couldn't make a field goal, so I didn't keep them," coach Doug Gatewood said. "Erin can actually do what we ask of her...she completes the passes I ask, she knows the plays. ... Anything I ask her to do, she does."

Taking the field during a regular season game could be a first in the state of Florida. According to the Sun-Sentinel, state officials are not sure whether a female QB has taken the field. State records researched by the paper indicated 523 girls had played football since 1973 in the state, with 36 playing last season.

Romney makes his case - 'Need jobs, lots of jobs' - NewsOK.com

TAMPA, Fla. (AP) ? Mitt Romney launched his fall campaign for the White House in a rousing Republican National Convention finale Thursday night, proclaiming America needs "jobs, lots of jobs" and promising to create 12 million of them in perilous economic times.

"Now is the time to restore the promise of America," Romney said in excerpts released in advance of his prime-time speech to a nation struggling with 8.3 percent unemployment and the slowest economic recovery in decades.

He muted his criticism in the advance excerpts of President Barack Obama, his quarry in a close and unpredictable race for the White House.

"I wish President Obama had succeeded because I want America to succeed," he said. "But his promises gave way to disappointment and division."

"This isn't something we have to accept ," he said, appealing to millions of voters who say they are disappointed in the president yet haven't yet decided to cast their votes for his Republican challenger.

"Now is the moment when we can stand up and say, 'I'm an American. I make my destiny. And we deserve better! My children deserve better! My family deserves better! My country deserves better!"

Romney's remarks came after other speakers filled out a week-long portrait of the GOP nominee as a man of family and faith, savvy and successful in business, savior of the 2002 Winter Olympics, yet careful with a buck. A portion of the convention stage was rebuilt overnight so he would appear surrounded by delegates rather than speaking from a distance, an attempt to soften his image as a sometimes-stiff and distant candidate.

"He shoveled snow and raked leaves for the elderly. He took down tables and swept floors at church dinners," said Grant Bennett, describing Romney's volunteer work as an unpaid lay clergy leader in the Mormon church.

Following him to the podium, Ted and Pat Oparowski tenderly recalled how Romney befriended their 14-year-old son David as he was dying of cancer. "We will be ever grateful to Mitt for his love and concern," she said.

Beyond the heartfelt personal testimonials and political hoopla, the evening marked one of a very few opportunities any presidential challenger is granted to appeal to millions of voters in a single night.

The two-month campaign to come includes other big moments ? principally a series of one-on-one debates with Democrat Obama ? in a race for the White House that has been close for months. In excess of $500 million has been spent on campaign television commercials so far, almost all of it in the battleground states of Florida, North Carolina, Virginia, New Hampshire, Ohio, Iowa, Colorado and Nevada.

Romney holds a fundraising advantage over Obama, and his high command hopes to expand the electoral map soon if post-convention polls in Pennsylvania, Michigan, Wisconsin and perhaps elsewhere indicate it's worth the investment. In a speech that blended the political and the personal, Romney talked in his excerpts of the importance of the love he felt from his parents and that he and his wife Ann have sought to give their children and grandchildren.

"All the laws and legislation in the world will never heal this world like the loving hearts and arms of mothers and fathers," he said.

As for Obama, he said, "Many Americans have given up on this president, but they haven't ever thought about giving up. Not on themselves, Not on each other. And not on America."

The economy is issue No. 1 in the race for the White House, and Romney presented his credentials as the man better equipped than the president to help create jobs. Speaker after speaker testified to the help their received from Bain Capital, the private equity firm that he created ? and that Democrats argue often took over firms, loaded them down with debt and then walked away with huge fees as they slid into bankruptcy.

"When I was 37, I helped start a small company," he said. "That business we stated with 10 people has now grown into a great success story.

Romney knows the value of dollar, delegates were assured.

"When I told him about Staples, he really got excited at the idea of saving a few cents on paper clips," businessman Tom Stemberg said of the office supply store chain he founded with backing from Bain Capital, the private equity firm the presidential nominee co-founded.

There was no shortage of Obama-bashing, though.

Former House Speaker Newt Gingrich, sharing the stage with his wife, Callista, said Obama was a president in the Jimmy Carter mold. Both "took our nation down a path that in four years weakened America's confidence in itself and our hope for a better future," he said.

Centenarian sister helps Sardinian siblings set world record

Nine Sardinians were recognized Wednesday as the oldest living siblings, with a combined age of 818. The eldest sister celebrated her 105th birthday today.

By Nick Squires,?Correspondent / August 22, 2012

Could the rugged Mediterranean island of Sardinia harbor the secret to a long life? Experts increasingly think so.

The island has long had a reputation for longevity, with one of the highest rates of centenarians in the world. Now that reputation has been further bolstered with the discovery of nine elderly brothers and sisters who have a combined age of 818 years.

The Melis siblings were officially recognized this week by Guinness World Records?as the world?s oldest living siblings.

It can surely only be a matter of time before ?The Sardinian Diet? becomes the next big thing among Hollywood stars and well-heeled health enthusiasts.

All but two of the siblings live in the village of Perdasdefogu in a mountainous region of the island known as the Barbagia, which in the past was famed for banditry, feuding, and kidnapping.

Its unforgiving terrain has repelled outside invaders since pre-Roman times, ensuring a distinct gene pool that appears to have passed on longevity from generation to generation.

The Melis family ascribes its extraordinarily long lives to plenty of exercise ? walking up and down precipitous slopes to feed its sheep and goats, for instance ? as well as a healthy diet based around bread, cheese and pasta, all locally produced. ?

Family members speak particularly highly of minestrone soup, which is filling but low in fat and full of greens. The red wine they drink is unusually high in antioxidants, experts have found.

Being surrounded by around 150 children, grandchildren, great-grandchildren, and great-great-grandchildren also keeps them young, they say.

The oldest of the siblings, Consolata, celebrated her 105th birthday today, while the ?baby? of the family, Mafalda, is a comparatively sprightly 78 years old.

?In my day women had to do all the domestic work, going to the standpipe to get water and to the river to wash the clothes. My grandchildren have washing machines and vacuum cleaners so when they say 'I?m so stressed,' I just can?t understand it,? Consolata told Italy?s daily Corriere della Sera.

One of the sisters, Claudina, 99, keeps in shape by walking to and from church every day, while a brother, Adolfo, 89, still works in a bar in the village and tends vegetables in his garden.

It was a family friend who approached Guinness claiming that the Melis siblings were probably the oldest in the world.

Guinness verified the claim in conjunction with the Gerontology Research Group in the US and announced the finding this week.

?The Mediterranean lifestyle is always held up as being beneficial to a long, healthy life, and Italians in particular feature prominently in the list of supercentenarians and centenarians,? said Craig Glenday, editor-in-chief for Guinness World Records.

?Seven out of the 70 people alive over the age of 110 are Italian, for example, and the world's second-oldest living person is the Italy-born Dina Manfredini, who was born in Emilia-Romagna," Mr. Glenday noted, adding that Ms. Manfredini now lives in the US.

?With all longevity records, genes and lifestyle are paramount, but luck plays a big part ? avoiding accidents and falls, and so on ? so to have such a large number of living siblings with an average age of more than 90 years is incredibly rare.??

The secret of Sardinians? long life is being studied by a scientific project called AKeA ? an acronym for ?A kent? annos,? a traditional toast in the Sardinian language which means ?May you live to 100 years.?

Scientists believe genetics play a key role in Sardinians? longevity ? the same surnames crop up again and again in the list of long-living islanders, said Luca Deiana, a professor of clinical biochemistry from the University of Sassari.

The only other region in the world that can match Sardinia for the proportion of centenarians is the island of Okinawa in Japan.

NFL veteran who played at UM to plead guilty to tax-related fraud charges in Miami

William Joseph, a University of Miami defensive tackle who played in the NFL for much of the past decade, plans to plead guilty to tax-related fraud charges in federal court Friday.

Joseph and others ? including former Oakland Raider teammate, running back Michael Bennett ? are accused of cashing dozens of fraudulently obtained tax-refund checks and seeking a loan with fake collateral. Their take totaled hundreds of thousands of dollars, according to court records.

Joseph, 32, of Miramar, has agreed to plead guilty to theft of government money and aggravated identity theft, the latter of which carries a mandatory two-year prison sentence.

?He recognizes the mistake he made, and he is going to take responsibility for his actions and do what he can to repair his good name,? Joseph?s attorney, Roderick Vereen, told The Miami Herald Thursday.

Earlier this year, FBI agents faked out the two ex-NFL football players and a former local high school star by setting up a check-cashing store ?front? in North Miami. The undercover operation sacked:

??Joseph, who was drafted in the first round by the New York Giants in 2003 and last played with the Oakland Raiders in 2010;

??Bennett, a University of Wisconsin running back who also was drafted in the first round by the Minnesota Vikings in 2001 and finished his career with the Raiders in 2011. Bennett, 33, of Tampa, pleaded guilty to a wire fraud charge in August, and;

??Louis Gachelin, a Miami Jackson High and Syracuse University defensive lineman who signed as a free agent with the New England Patriots in 2004. Gachelin never made the final roster. In July, Gachelin, 31, of Miramar, pleaded guilty to theft of government money and aggravated ID theft.

Authorities say the tax-fraud case, while unique because of the ex-NFL defendants, is yet another example of the escalating number of reported identity-theft crimes in Florida and nationwide.

U.S. Attorney Wifredo Ferrer has described identity theft as ?America?s fastest-growing crime,? claiming thousands of legitimate consumers and taxpayers as victims, especially in the Miami and Tampa areas.

In May, Joseph, Gachelin and five other defendants were charged with cashing a total of about $500,000 in fraudulently obtained tax-refund checks, forging signatures on the checks and unlawfully using identification documents such as a driver?s license. As part of the sting, the FBI charged 35 percent to 45 percent in fees to cash the checks.

Bennett tried to obtain a $200,000 loan in April from the FBI?s fake check-cashing store, using a UBS financial statement falsely showing that he had $9 million in collateral, according to court records. It was Bennett?s former Raiders? teammate, Joseph, who introduced him to the undercover store in North Miami.

Joseph was tripped up by another defendant, Lanny Fried, 34, of Miami Lakes, who got caught trying to cash checks at the store and then began cooperating with agents to target the former NFL player. In July, Fried also pleaded guilty to theft of government money and aggravated ID theft.

In his plea agreement, Fried admitted he knew that several checks he brought to the store had been fraudulently obtained.

Here?s the root of the problem: Scammers filing fabricated tax returns have exploited a hole in the IRS electronic filing system, according to the U.S. Government Accountability Office.

The federal watchdog agency found that the Internal Revenue Service does not match tax returns to the W-2 income forms that employers file until months after the filing season ends on April 15. Employers file them in late February or early March; the IRS does not match them up with employees? incomes reported on 1040 forms until June.

That?s way too late to catch identity thieves who file false returns in other people?s names early in the year and have already received and cashed the refund check.

The GAO says the number of ID theft-related fraud incidents on tax returns hit 248,000 in 2010, about five times more than in 2008.

According to the Treasury Department, that figure has since soared. In May, a Treasury inspector general testified the IRS reported that about 940,000 tax returns with refunds totaling $6.5 billion involved identity theft.

Those 2011 returns accounted for 42 percent of about 2.2 million ?fraudulent? tax returns that year, according to the IRS.

NFL to use replacement officials for Week 1

(AP) ? The NFL will open the regular season next week with replacement officials and said it was prepared to use them "as much ... as necessary" afterward.

Replacements will be on the field beginning Wednesday night when the Dallas Cowboys visit the New York Giants in the season opener, league executive Ray Anderson told the 32 teams in a memo. Negotiations are at a standstill between the NFL and the officials' union.

The NFL Referees Association was locked out in early June and talks on a new collective bargaining agreement have gone nowhere. Replacements have been used throughout the preseason, with mixed results.

In 2001, the NFL used replacements for the first week of the regular season before a contract was finalized. The speed of the game and the amount of time starters are on the field increase exponentially for real games, making the replacements' task more challenging.

Anderson, the NFL's executive vice president of football operations, told the clubs in a memo Wednesday that the replacements will work "as much of the regular season as necessary," adding that training with each crew will continue.

The NFL noted it has expanded the use of instant replay as an officiating tool this year to include all scoring plays and turnovers. Officiating supervisors will be on hand to assist the crews on game administration issues.

"We are not surprised, based on Ray Anderson's statements ... that the NFL was not going to reach out to us," NFLRA spokesman Michael Arnold said. "However, this is consistent with the NFL's negotiating strategy which has been 'take it or leave it and lock them out.' It now appears the NFL is willing to forego any attempt to reach a deal in the last seven days before opening night."

The NFL Players Association, which went through a 4 ?- month lockout last year before settling on a new contract, expressed disappointment about the decision to use replacements.

Colts safety Antoine Bethea said there is a feeling of solidarity with the officials.

"They've got to do what they've got to do, and we were in a similar situation a little while ago," Bethea said. "So you can't fault those guys for doing what they have to do."

Anderson said the sides remain considerably apart on economic issues, including salary and retirement benefits. He also told the teams there is a substantial difference on operational issues.

"One of our key goals in this negotiation is to enhance our ability to recruit, train, and replace officials who are not performing adequately," Anderson said. "We believe that officials should be evaluated and performance issues addressed in the same way as players, coaches, club management and league staff. We have proposed several steps to accomplish this, including having a number of full-time officials and expanding the overall number of officials."

The NFL is offering to add three full officiating crews, increasing the total number of officials to 140. The NFLRA insists the compensation being offered with such an increase would reduce the officials' pay.

The league is proposing having seven officials ? one per position of referee, umpire, line judge, side judge, back judge, field judge, head linesman ? who would train, scout, handle communications, safety issues and rules interpretations year-round. Now, all NFL game officials are part-time employees, with outside jobs ranging from lawyers to teachers to business owners.

In response, the NFLRA has said it is not opposed to full-time officials "if they are fairly compensated."

The union also disputes the value of the league's current salary offer, which it says would not be the 5 percent to 11 percent increase the NFL claims.

And the union questions the league's adherence to player safety initiatives by using replacement officials, none of whom has recently worked Division I college games. Many of the officials who were replacements in 2001 came from the Division I level.

"The league has placed a lot of emphasis on player health and safety in the last few years and we do feel we are an integral part of that," Arnold said. "We think it is unfortunate and we really don't understand why the league is willing to risk playing safety and the integrity of the game by utilizing amateur officials."

Anderson told the teams that the replacements have "undergone extensive training and evaluation, and have shown steady improvement during the preseason."

Arnold disagreed.

"The referees want to get back on the field," Arnold said. "Our members have been engaged in extensive preparations and are ready to go."

Chael Sonnen?s pizzeria selling the Jon Jones special ? full of chicken and cheese

Jon Jones' refusal of a bout with Chael Sonnen may have led to a cancellation of fights set for Saturday night, but it also led to a whole new pizza at Sonnen's Mean Streets Pizza. TMZ found Sonnen's pizzeria has a whole new pizza in Jones' honor.

Though it doesn't sound particularly appetizing, the pizza is full of chicken and cheese. Sonnen throws two more barbs at Jones by saying the deal is only good until "the chicken runs out," and offers delivery so to "avoid a DUI." Jones crashed his Bentley into a tree when driving drunk in May.

Holliday's 4 hits power Cards past Reds

Associated Press Sports

updated 5:02 p.m. ET Aug. 26, 2012

CINCINNATI (AP) - Matt Holliday is hoping to play a key role in another playoff run for the St. Louis Cardinals. He sure got plenty of help on Sunday.

Holliday had four hits and four RBIs, Adam Wainwright won his fifth consecutive start and the Cardinals beat the Cincinnati Reds 8-2 on Sunday.

Allen Craig homered and drove in three runs as St. Louis handed the Reds their second series loss in 13 sets since the All-Star break. The Cardinals have won five of six to move within six games of the NL Central-leading Reds.

"Holliday had a huge day," manager Mike Matheny said. "It's amazing how the conversations outside of this clubhouse start questioning him. It's not long before he shows everybody how much he means to us."

Holliday is batting .444 (12 for 27) with eight RBIs in his last six games. St. Louis stormed to the World Series title last year and is leading the race for the final NL wild card this season, but is still holding out hope for catching Cincinnati in the division.

"I'm just trying to do my part," Holliday said. "This is a team game. We only play the Reds three more times. We are going to need some help."

St. Louis' 17 hits are the most allowed by Cincinnati in one game this season. The Cardinals collected 42 hits while taking two of three in the weekend series.

"Those guys are all hitting .300," Reds second baseman Brandon Phillips said. "I don't know who is making outs for that team."

Wainwright (13-10) allowed two runs and six hits in 5 2-3 innings while improving to 6-0 with a 1.80 ERA in his last seven starts overall. The 6-foot-7 right-hander, who missed all of last season because of elbow surgery, hasn't lost since July 18 at Milwaukee.

"I wanted to take my team further in the game than that, but I get it," Wainwright said. "I had a couple of games in a row that I threw a lot of pitches."

Reds manager Dusty Baker said Wainwright was on his game.

"Wainwright threw the ball well," Baker said. "There's not much else to say, except they beat us."

Reds right-hander Homer Bailey (10-9) gave up five runs in six innings while falling to 1-3 with a 6.04 ERA in five August starts. He also allowed a season-high nine hits for the sixth time.

The Cardinals strung together four consecutive ground-ball singles during a five-hit third inning that plated three runs. Skip Schumaker led off with a double to right-center, and Wainwright chipped in with a one-out single into left field. Schumaker scored on Jon Jay's base hit up the middle and Matt Carpenter singled to load the bases before Holliday's two-run single to left.

"With Wainwright on the mound, we felt pretty good with those first three runs," Holliday said.

St. Louis added two more in the sixth to make it 5-0. Holliday hit a leadoff triple before Craig drove a 1-2 pitch over the wall in left for his 20th homer.

"The two Matts got on base. That got us started. I take pride in driving in runs," Craig said.

Chris Heisey and Ryan Ludwick had RBI singles in the sixth for Cincinnati, which beat the Cardinals 8-2 on Saturday.

Holliday also doubled in a run in the seventh and singled in Carpenter in the ninth.

NOTES: Reds 1B Joey Votto is scheduled to start a rehab assignment Tuesday at Single-A Dayton, perhaps the last step of his comeback from two minor surgical procedures related to a torn meniscus in his left knee. The Reds are 27-14 since Votto left the lineup. ... RHP Nick Masset was awaiting the results of an MRI on his right shoulder after soreness returned following his rehab appearance with Triple-A Louisville on Aug. 21. Masset has been on the disabled list since spring training. ... The Reds and Cardinals meet one more time this season, in the final series Oct. 1-3 in St. Louis.

The Effective Measures to Improve the Rotor Bearing Life | Internet ...

Compound crusher is widely used in the fine crushing of limestone, clinker, coal and other minerals in building mining, metallurgical and chemical industries, and also used in the fine crushing of dolomite and the chamotte, gold, serpentine, high slag, gangue and phosphate rock, these med-hardness materials. com/combination-crusher.html">combination crusher is suitable for sand making of hard limestone, dolomite, granite, basalt , and highway stone crushing. The compression strength is less than 140 Mpa. The humidity is not more than 15%.
The combination crusher is one of the most common equipment in crushing and sand making production line, while its motor is usually damaged; Hongxing machine experts holds view that there are many reasons lead to the damage of combination crusher motor; besides conventional failure cause of common motor power equipment, the running fault of combination crusher also can damage the motor, shown as follows:
1. The reliability and sensitivity of the automatic pressure switch; the starts and stops of compound crusher are normally controlled by the automatic pressure switch (pressure relay) directly driving alternating current contactor. The automatic pressure switch mostly adopts mechanical structure, which act on contact by the compress and release of spring. The congenital deficiencies or improper adjustment of automatic pressure switch can cause motor damage.
2. The electrical control (especially for low-power type) is relatively simple, they are generally work independently by stand-alone group and lying in un-professional operation occasions with torpid repair and maintance, which relatively increase in repeat expansion rate of failure.
Due to the combination crusher works in harsh conditions in long term, the wear of rotor bearing is exacerbated. The rotor is irreplaceable for crusher so that crusher cannot work without it. However, it is also fragile; the bearing rotor is not only expensive, but also replaced difficultly, often resulting in the cut-off loss.
How to take effective measures to improve the rotor bearing life is an important matter that our customers concern about, asking us pay more attention:
First, make correct choice of rotor-bearing model. Double row radial spherical roller bearing with strong bearing capacity and aligning performance, it is worthy being chosen. In addition, the rotor which is with design life of 5000 ~ 10000h is appropriate.
Second, improve the force status of crusher bearing. The impact load working on the bearing depends on the impulse acting on the rotor and the support flexibility of bearing. Increasing bearing support flexibility will reduce the impact load working on the bearings. To this end, we could add rubber sheet with appropriate thickness between the bearing and the support frame to improve the bearing support flexibility and to achieve the purpose of extending the service life.
They are widely used for crushing various materials like stone, granite, trap rock, coke, coal, manganese ore, iron ore, emery, fused aluminum, oxide, fused calcium carbide, lime stone, quartzite, alloys, etc. These crushers are recommended by leading consultants in this field and are used by hundreds of customers all over the world.

Michael Atkins - Seattle Trademark Lawyer - Analyzing the ...

Following is a guest post from my former student and recent UWSL LL.M. graduate, Aman Gebru, on the evolving?theory of contributory trademark dilution, a claim he notes recently got traction in a local case.?This?post is adapted from his seminar paper entitled: ?The Claim of Contributory Dilution under the Trademark Dilution Revision Act.? In the fall, Mr. Gebru will continue his legal studies at the?University of Toronto, where he will pursue the equivalent of a Ph.D.

Praise and criticism?for claim of contributory dilution:

?[It is] the most pernicious concept ever to come out of trademark theory.? -Mark A. Lemley, The Modern Lanham Act and The Death of Common Sense.

?[S]ome form of imputed liability for dilution is no more ?pernicious? than dilution itself? -John T. Cross, Claim for Contributory and Vicarious Liability.

??While there is no authority directly on point, there would seem to be no logical reason why the doctrine of contributory infringement should not apply to a claim under the federal anti-dilution law.? -J. Thomas McCarthy, McCarthy on Trademarks.

?It would be inconsistent with the Trademark Dilution Act to prohibit a cause of action for contributory dilution.? -Hon.?Ricardo Martinez, Microsoft v. Shah, No. 10-653 (W.D. Wash. Jan. 12, 2011).

Imagine that Napple, a famous electronics producer, has succeeded in giving consumers a ?high-social-class? impression through its smart-phone and laptop products. Simply put, consumers feel classy when they purchase Napple?s products. Marketers have identified?this method of marketing is what drives the high demand for Napple?s products. MicroGoogle, Napple?s arch-rival, wants to destroy the advantages its competitor has gained through this strategy. MicroGoogle?s CEO consults her lawyers, who say if MicroGoogle uses Napple?s trademark in a confusing way?or?directly dilutes it, they would be liable. Therefore, MicroGoogle?s CEO decides that?MicroGoogle instead should use Napple?s trademarks in a way that reduces its high-class impression. The strategy works, and?a sharp decline is noticeable in Napple?s sales shortly thereafter. Within weeks, MicroGoogle decides to go for the kill shot, and?pays the influential ?Rapper?Snapper,? to use offensive slang in reference to people using Napple?s products in his music. Napple, furious about the issue,?decides to bring a suit against MicroGoogle.???

Does Napple have a valid claim for contributory dilution against MicroGoogle?

The cause of action for dilution is unique in trademark law. Traditionally, protection was limited to guard against the confusing use of?a distinctive mark, in an effort to?protect?consumers. Under?dilution principles, there is no requirement to show confusion. In dilution,?the plaintiff is saying ?I have invested so much in promoting my famous mark, and its?distinctiveness is being ?blurred,? or its wholesomeness is being ?tarnished,? by the defendant.?

Although the?dilution?has become?widely accepted, the claim of contributory dilution has had a different fate. Most?courts faced with the claim failed to give direction?as to?whether a valid claim for contributory dilution exists. While Congress had the chance to clarify the confusion when it enacted the Trademark Dilution Revision Act of 2006,?it actually?added to the confusion when it excluded the contribution to a ?fair use dilution? from liability and kept silent about the contribution to ?non-fair-use? dilution. The confusion has not been clarified for some time.

That is, until the Western District?recognized what some have called???a novel cause of action? and denied a motion to dismiss?the claim in July?2012 in Microsoft v. Shah. While earlier courts struggled with the notion that such a cause of action should be recognized, Judge Ricardo Martinez?held: ?It would be inconsistent with the Trademark Dilution Act to prohibit a cause of action for contributory dilution.???Since most of the decisions regarding the cause of action have been made by trial?courts, however, it is still not clear if?a valid claim for contributory dilution will exist on a broader scale. The issue becomes more interesting when one considers the enormous amount of investment required to create a?famous, wholesome, and highly distinctive mark. The recent debate and lobbying regarding proposed SOPA/PIPA legislation may also put pressure on the issue of contributory liability for dilution online.?

My paper (accessible?here) discusses?case law regarding contributory dilution from various circuits and analyzes the direction courts seem to be heading. I argue that even if the status of the claim is not yet clear, courts should give broader?recognition to the claim and use existing jurisprudence to provide for its elements?? similar to?the accepted cause of action for contributory?trademark infringement.

Thank you, Aman!

N.B.?Readers may remember the Shah decision from STL?s post here.

The Importance Of Satellite tv Terminals | TechnologiesA-Z.blogspot ...

These days, communication plays such an natural part that many varieties of technology possess advanced so much in permitting people, companies, and other entities to easily talk on the fly, regardless of the medium

    Satellite phone sales

. How this is possible is to use satellite terminals. A satellite television terminal is very important because it permits both stationary and mobile entities in order to continuously be connected to the Internet, therefore enabling them to communicate by utilizing powerful sources such as voice, text as well as video. All of this is possible, due to the fact satellite terminals allow visitors to connect to the Internet to send as well as download digital data promptly. So, the fact that just how potent this type of technologies is, you can understand why industrial sectors such as these involved in maritime and all other forms of transportation makes a lot use of that.

For example, yachts that take a trip the oceanic masses rely on this form of conversation heavily, with there being times in which an emergency can occur, such as one resulting from a storm, or perhaps because they needs to change path during their journey. Satellite terminals make sure that you could do this, as it offers these yachts the ability to continuously be connected to the Internet, no matter where they are in the world. One way in which satellite television terminals work is by supporting shipping folks to stay in connection with their families as well as other loved ones. Let's be honest, when you expended so many several weeks on the sea, it can grow to be very depressed, and the best way to keep your spirits lifted is simply by communicating with whoever has meaning in your own life.

Of course, the bandwidth speeds that you get largely depends on how big the satellite television dish you're using. For instance, if you use single.2 multi meter dish aerial, then you will usually be able to get speeds of up to Some megabits per second. The higher the speed, the better off you are at acquiring quality streaming, whether it is voice or video clip. So, regardless if you are in the delivery industry, or some other type of market that involves transportation, you will find that satellite television terminals will most likely play a very important role to keep your business working well satellite phone plans. In the end, the harder communication you are able to make with those that are near far ranges from your primary headquarters, the harder efficient the complete process have been around in ensuring that goods or individuals transport from one place to yet another in a safe and sound environment. Actually, when we realize just how much technology has gone in terms of conversation, one are not able to help yet to ponder how everyone was able to endure with the restricted technology utilized in the past.

Rumor: Apple will wait until October to announce smaller iPad

    16 hrs.

Rumor is that Apple will hold a very special event on Sept. 12. The general assumption is that Apple will announce the next-generation iPhone and a smaller iPad, but now some are suggesting that the Cupertino-based company will wait until October to talk about what's being dubbed the "iPad Mini" or "iPad Air."

Let's be clear: We don't actually know if Apple is even working on a smaller iPad. All we have to go on are reports from anonymous sources and leaked?parts which are?allegedly?intended for this tablet. There's currently ?no official word from Apple confirming the existence of the iPad Mini. But where there's smoke, there's occasionally a fire.

Tech blogger/Apple watcher John Gruber ? who has a good track record when it comes to reasoning out details ? seems convinced that the smaller tablet is coming, but not until October.?

"I don?t think Apple would want reviews of both a new iPhone and new-size iPad appearing at the same time," Gruber?writes. "The iPhone is too big, too cool, and garners too much attention ? and it?s in Apple?s interest to keep that attention undiluted."

Instead of having two new devices share the stage in September, Apple will likely use the first or second week of October ??when it typically holds a music-themed event ??to unveil the new iPad (and perhaps some new iPod devices), Gruber speculates.?Jim Dalrymple, another well-connected tech writer and?Apple follower with a solid track-record on rumors,?is nodding along.?

"Oh, that Gruber is a smart fellow," he simply adds.

For what it's worth, we frequently reach out to the folks at Apple and ask them if they're feeling crazy enough to?chit-chat about their upcoming products, but as it's their policy not to address such rumors, we'll have to?keep speculating until the cows come home?? or until?the Apple executives?come to the Moscone Center.

Want more tech news?or interesting?links? You'll get plenty of both if you keep up with Rosa Golijan, the writer of this post, by following her on?Twitter, subscribing to her?Facebook?posts,?or circling her?on?Google+.

Drone strike may have killed Haqqani network leader

ISLAMABAD (Reuters) - A CIA drone strike in Pakistan may have killed the operational commander of the Haqqani network, the insurgent group behind some of the most high-profile attacks on Western and Afghan government targets in Afghanistan, Pakistani intelligence officials and militant sources said on Saturday.

The officials said Badruddin Haqqani, who is also believed to handle the network's vital business interests and smuggling operations, may have been killed during a drone strike this week in Pakistan's tribal North Waziristan region.

One senior Pakistani intelligence official said Badruddin had fled a compound that he and other militants were in after it was hit by a missile, then was killed by a second drone strike on a car that he was in.

There was no official word on Badruddin's fate from the Haqqani network. Other intelligence officials were more cautious.

"Our informers have told us that he has been killed in the drone attack on the 21st but we cannot confirm it," said one of the Pakistani intelligence officials.

If Badruddin's death is confirmed, it could deal a major blow to the Haqqanis, one of the United States's most feared enemies in Afghanistan.

The Haqqanis are the most experienced fighters in Afghanistan and the loss of one of the group's most important leaders could ease pressure on NATO as it prepares to withdraw most of its combat troops at the end of 2014.

"We are 90 percent sure that he was in the same house which was attacked with a drone on Tuesday," said another Pakistani intelligence official.

Sources close to the Haqqqani network also said Badruddin was believed to be in the house, hit by a drone strike as militants were planting explosives in a vehicle meant to be used for an attack on NATO forces in Afghanistan.

"The drone fired two missiles on the house last Tuesday and killed 25 people, most of them members of the Haqqani family," one of the sources said.

Pakistani Taliban and tribal sources said they believed Badruddin was killed in the drone attack.

One of Badruddin's relatives said he was alive and busy with his "jihad activities".

"Such claims are baseless," he told Reuters. Another relative told Reuters Badruddin is "alive and well".

Afghanistan's Taliban movement, allies of the Haqqani network, said Badruddin was alive.

    SERIES OF DRONE STRIKES

A series of drone strikes in North Waziristan this week suggest the CIA, which remotely operates the aircraft, was after a high-value militant target in the unruly area.

The deaths of militants in such strikes are difficult to confirm because they often occur in remote areas of regions in the northwest like North Waziristan that are hard for authorities to reach.

U.S. officials blame the al Qaeda-linked network for some of the boldest attacks in Afghanistan, including one on embassies and parliament in Kabul in April which lasted 18 hours, killing 11 Afghan security forces and four civilians.

The United States accuses Pakistan's intelligence agency of supporting the Haqqani network and using it as a proxy in Afghanistan to gain leverage against the growing influence of its arch-rival India in the country.

    Pakistan denies the allegations.

Militant groups from Afghanistan and Pakistan have formed alliances and often cross the porous border for operations.

A NATO air strike in eastern Afghanistan has killed a commander of the Pakistani Taliban, both NATO and the Taliban said on Saturday.

Both sides identified the dead commander as Mullah Dadullah and said several of his comrades were also killed in the attack on Friday.

A NATO statement did not say who carried out the assault, but the alliance is alone in having the air power to conduct such an operation. It said Dadullah's deputy, Shakir, was also killed.

"Dadullah, also known as Jamal, was responsible for the movement of fighters and weapons, as well as attacks against Afghan and coalition forces," the statement said.

It said Afghan and coalition forces backing the Kabul government had "conducted a post-strike assessment" and found that there had been no civilian casualties or damage to civilian property.

Pakistani Taliban officials, as well as Pakistani intelligence officials said Dadullah had been killed in a house in eastern Konar province, along with 12 bodygards. They said he was the leader of the Taliban in Pakistan's Bajaur tribal agency, near the border with Afghanistan.

Dadullah, in his 40s, replaced Maulvi Faqir Mohammad last year after Mohammad told the media that the Taliban were holding peace talks with the government.

The Pakistani Taliban, committed to the same Islamist principles as the Taliban ousted from power in Kabul in 2001, replaced Mohammad with Dadullah to undercut the secret negotiations, Taliban commanders say.

Some Pakistani Taliban fighters and commanders were forced to flee into Afghanistan after the Pakistani army launched a series of offensives against them in 2008 and 2009.

But they still carry out cross-border raids on Pakistani armed forces. In June, the Pakistani Taliban said they beheaded 17 Pakistani soldiers in a cross-border raid.

UK University Awarded Bioenergy Research Funding

UK University Awarded Bioenergy Research Funding

UK - Aston University Bioenergy Research Group (BERG) has been awarded ?424,000 of research funds, as part of the new SUPERGEN Bioenergy hub.

This research consortium will bring together industry and academia, and is funded by a ?3.5 million grant from the Engineering and Physical Sciences Research Council (EPSRC) as part of the RCUK Energy Programme. It will investigate the efficiency and whole-life impact of a variety of biofuel processes and accelerate the deployment of sustainable bioenergy.

Professor Tony Bridgwater of Aston University will be leading two of the ten research projects as follows:

    Upgrading of bio-oil

Turning biomass into transport fuels is a significant research challenge as substantial processing and upgrading are required to meet biofuel specifications. One way of stepping towards that objective is to produce bio-oil by fast pyrolysis and upgrade that only to the minimum extent required to allow it to be mixed with mineral oil in a conventional refinery. New approaches to this will be evaluated experimentally to establish the feasibility and potential greenhouse gas reductions.

Techno-economic assessment of biofuels by pyrolysis

There are many different pathways from woody biomass to biofuels, some of which are only just emerging and it makes sense to focus research effort on the more efficient and lowest cost processes, as well as those most likely to deliver significant and cost effective greenhouse gas reductions. Whole systems analysis of novel biofuel technologies will be carried out to screen for the most promising technology options.

The hub starts work in August for a five-year period and will be directed by Dr Patricia Thornley at the Tyndall Centre for Climate Change Research, University of Manchester.

HBT: Lannan leading candidate to replace Strasburg

Whenever the Nationals shut down Stephen Strasburg the ?leading candidate? to replace him in the rotation is John Lannan, according to James Wagner of the Washington Post.

Lannan has spent nearly all of this season at Triple-A despite throwing 185 innings with a 3.70 ERA for the Nationals last season and being paid $5 million this year. And he hasn?t even been much good in the minors, starting 22 games with a 4.89 ERA and 74/49 K/BB ratio in 131 innings.

He has, however, pitched reasonably well in a pair of spot starts for the Nationals and is already on the 40-man roster, making Lannan a guaranteed September call-up.

Higher Education Becomes Nevada Campaign Issue for Obama

Nevada students taking the ACT college entrance exam have a slight college readiness edge over the national average, the Associated Press reports. Whereas the national average score is 21.1, Nevada college entrants score on average 21.3. Affording a higher education is of great concern to voters in this presidential battleground state.

Reaching the College Audience in Reno and Las Vegas

President Barack Obama actively seeks out contact with college- and college-ready students in the Silver State. As noted by the New York Times, the president visited Reno's Truckee Meadows Community College campaign rally yesterday and spoke to a Las Vegas high school audience at Canyon Springs High School today.

Differentiating Democratic Policies from Republican Counterparts

The Obama campaign highlights that an enacted Republican budget would lead to severe cuts in education. Mr. Obama outlines that Mitt Romney's best advice to college-bound students is little more than asking parents for loans -- or finding the cheapest colleges to attend. Concurrently, the Obama campaign must take on the charge of the Romney campaign, which has painted college students as a "lost generation" heavily burdened by increasing tuition costs that the Obama administration has failed to curtail. Another talking point the Obama campaign must tackle is Nevada's high unemployment rate, which affects recent college graduates with high student loan debts.

Attacking Republican Talking Points on Education

The Obama campaign underscores Romney's image of being "out of touch with the financial needs of college students," the Reno Gazette Journal explains. While speaking to the Reno college crowd on Tuesday, the president used Romney's words -- to borrow money from parents -- to highlight that this suggestion was unrealistic in an economically challenged state, where parents frequently barely make ends meet. "Hearing Obama say he will help with the student loans, grants and just the financial aid gave me a new sense of hope," a student told reporters after the rally.

    Resonating with Voter Concerns

Reception of the president's message on education has been positive at Nevada's campaign stops. "We have been talking about health care and other issues and education has been put on the side, so I loved the fact that it was his primary focus today," and adult in the audience explained.

    Eliciting a Republican Response

The Romney campaign continues to point out that the cost of a higher education has mushroomed uncontrolled under the Obama administration. The campaign also faults the administration for creating an economic climate that makes it harder for new graduates to enter the job market. Romney, the campaign contends, will "encourage innovation and competition to make college more affordable, and his economic policies will give recent graduates the job opportunities they deserve."

Some Nevada Voters want more Details

Although the message of the Obama campaign was overall well received at the Reno and Las Vegas campaign stops, some Silver State voters want more details. Expressing this point of view is the Las Vegas Review-Journal, which asks pointedly if college students would do better with policy-driven tuition reductions and student loan increases, or if students would be better served by an administration that focuses on economic policies to benefit graduates.

Retailers & Restaurant Owners Turn To iPad To Engage Customers ...

The digital age is here, yet paper and print still dominate the landscape within retail stores and restaurants. However, a new trend is beginning to emerge.? As the cost of tablet computers and digital monitors continue to fall, the more progressive businesses have begun placing them around their businesses.?? The iPad specifically has become a favorite amongst business owners given its reliability and the selection of apps available on the market today.

While the trend is still in its infancy, the use of tablets in businesses has become almost common place in trendier areas including San Francisco and Washington DC.? Larger brands such as JC Penny have publically announced plans to replace the majority of their cash registers with iPad point of sale systems.? Also, OTG Management recently said they plan on installing 7,000 iPads for public use in North American airports in an effort to draw more people to their restaurants.

Below are some of today?s more common uses of iPads within the retail/restaurant environments:

Social Media & Email Address Collection

iPad App To collect email addressesMany businesses struggle to find an effective way to get more Facebook Likes and email subscribers.? Traditionally, businesses have placed paper & pen email signup forms by checkout counters as well as ?Like Us On Facebook? posters.? These static methods do little to grab a customer?s attention and entice them to take action.

OnSpot Social is an iPad app that collects email addresses and contact information from customers and passersby.? Also, the iPad app Likes Facebook Pages as well as follows Twitter accounts.? With animated graphics and full screen messages, the app is able to attract and engage customers.

    Point of Sale (POS) Terminals

As an iPad is basically a portable, full functioning computer with a touch screen, it makes sense it would work well as a point of sale terminal.? Retailers and restaurant owners are quite interested in this new possibility as certain iPad POS systems are considerably less expensive than the traditional.? Big name players in this area include Revel Systems and POS Lavu.

    Restaurant Menus

    Use iPad As Menu

Stacked restaurant allows customers to create their own burgers on iPads setup at each table

Some restaurants have taken the iPad initiative to new lengths by placing iPads at every table to be used as menus.? Stacked, a newer burger restaurant, has employed this tactic with much success.? Customers are able to actually build their entire burger through an easy to use interface on a tableside iPad.

    Web Browsing

Coffee shops and other local hangouts historically have supplied newspapers and magazines to keep patrons occupied.? Those catering to the tech savvy crowd have started installing iPads at tables and counters around their establishments to allow customers to check email, read the news, or simply surf the web.
